Introduction

LG Trade Finance, a simplified joint stock company with its office at 29 rue de Bassano, 75008 Paris, registered in the Paris Trade and Companies Register under number 812 985 539 acting under the brand name SAVETRADE (hereinafter referred to as “SAVETRADE”), in its capacity as data controller, attaches great importance to the protection of and respect for your private life.
This privacy policy is to inform you of the collection, processing of certain personal information that identifies you or is associated with you (hereinafter “Personal Data”) in connection with the use of our logged software platform (in SaaS mode) entitled “CARE” accessible via Internet at “care.savetrade.com” (hereinafter the “Platform”).

SAVETRADE is committed to ensuring respect for the fundamental rights of natural persons to confidentiality and protection of their data in accordance with the French law “Informatique et Libertés” No. 78/17 dated 6 January 6, 1978 and the “EU Regulation 2016/679” – General Data Protection Regulation (hereinafter the “GDPR”) of the European Parliament and the Council of April 27, 2016, which entered into force on May 25, 2018.

We invite you to read this document carefully to learn about and understand our practices regarding the processing of your Personal Data by us.
Personal Data means « any information relating to an identified or identifiable natural person. An “identifiable natural person” is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity. Personal data which have been pseudonymized but which can still be attributed to a natural person by means of additional information must be considered as relating to an identifiable natural person ».
The term “processing” of personal data means any operation or set of operations which is/are performed upon personal data or a set of personal data, such as collection, storage, use, disclosure or erasure.

When and what personal data do we collect?

SAVETRADE collects and processes directly from you, in particular during our professional exchanges, your Personal Data which is mandatory for authentication purposes to create a user profile in order to enable you to connect to our Platform. To this end, we may collect mainly your email address, but it may also include data relating to your identity such as your surname, first name, job title/position, telephone number. These Personal Data is accessible from the “Primary contact information” tab once you have logged on to our Platform.

Some of these details are mandatory and enable us to create a user profile with a secure personal login and password for you to authenticate yourself and access our Platform. If you fail to do so, SAVETRADE will not be able to provide you with the services offered by the Platform and you will not be authorized to log on. You may update your login details at any time by contact us (see below).

Why is your Personal Information collected?

SAVETRADE collects your Personal Data for some or all of the following main purposes:

  • To provide you with access to the Platform by creating a user profile and to ensure and/or improve the functionality of the Platform. This processing is necessary for the purposes of the operation and security of the Platform;
  • The management, processing and follow-up of your requests and exchanges with SAVETRADE via the Platform (e.g. requests for information, documentation, etc.);
  • For the purpose of complying with legal and regulatory obligations resulting in particular from SAVETRADE’s activity.

Depending on the purposes pursued and determined above, the lawful basis for such processing of personal data may vary. In general, such processing is necessary according to the legal bases set out in the GDPR, namely:

  • For the management, processing and follow-up of your requests to SAVETRADE (in particular, responses to requests for information), which may in some cases be considered necessary for the performance of our professional relationship;
  • To pursue SAVETRADE’s legitimate interests in the management and monitoring of its relations with users of the Platform;
  • In order to comply with legal and regulatory obligations imposed on SAVETRADE as data controller (in particular with regard to the fight against fraud, money laundering, etc.) and to comply with any request from a supervisory, judicial, criminal or competition authority.
With whom do we share your personal data?

We never disclose, sell, rent or lease your Personal Data to third parties such as third-party companies for marketing purposes.

The Personal Data collected may only be made available to the following categories of persons:

  • To SAVETRADE staff and/or any entity working on behalf of SAVETRADE;
  • To technical service providers and subcontractors, technical consultants, counsels (lawyers), experts;
  • To duly authorized administrative and/or judicial authorities in the event of an offence or breach of the Terms of Use or when the communication of personal data is required by law.
How do we protect and store your personal data?

SAVETRADE implements appropriate technical and organizational measures, considering the nature of the data and the risks involved in processing it, to preserve the security and confidentiality of your Personal Data and, in particular, to prevent it from being distorted, damaged or accessed by unauthorized third parties.

These measures may include, but are not limited to, practices such as limited access to data by personnel in departments that are authorized to access the data by virtue of their position, contractual safeguards when using an external service provider, regular reviews of our privacy practices and policies, and/or physical and/or logical security measures (e.g., secure access, authentication processes, back-ups, anti-virus software, firewalls, etc.).

All the data you provide to us is stored on secure third-party servers, namely the servers of Amazon Web Services located in France.

How long will your personal data be kept?

We will ensure that we keep your personal data for no longer than is necessary for the purposes set out in this Privacy Policy for which it was collected or as required by applicable law.

What are your rights regarding your Personal Data and how to contact us?

In accordance with the regulations in force and in particular the amended French law n°78-17 (dated of January 6, 1978) and the GDPR, you have the following rights, at any time:

  • The Right of access, to rectification and/or to erasure your Personal Data : You may request access to your Personal Data, to understand what data is being processed, to verify the lawfulness of the processing ; to correct erroneous data about you ; to delete your Personal Data in certain circumstances, in particular when such data is no longer necessary for the purposes for which it was collected or if it has been unlawfully processed;
  • The Right to object to the processing of your Data: You may object to the processing of your Personal Data at any time in certain circumstances. SAVETRADE must cease processing Personal Data unless it can demonstrate compelling legitimate grounds for the processing that override your interests, your rights and freedoms;
  • The Right to restriction of processing of your Data: you can obtain the limitation of the processing of your Personal Data when the data is inaccurate;
  • The Right to data portability: you have the right to receive in a structured, commonly used and machine-readable format, the Personal Data concerning you;
  • The Right to withdraw or modify your consent at any time to the collect and the processing of Data;
  • The Right to lodge a complaint and/or claim with a competent supervisory authority responsible for data protection (i.e. the “Commission Nationale Informatique et Libertés” (CNIL) in France: cnil.fr) or to seek legal indemnification if your Data is misused.

We will inform you of the measures taken in response to your request as soon as possible and in any event within one month of receiving it. However, we reserve the right not to follow up on requests that are clearly unfounded and/or excessive.

Cookies Policy

When you connect to the Platform and during your navigation of the Platform, we use cookies may be stored on your computer and/or any other terminal device you may use to log in to our Platform.

The term “cookies” refers to text files containing a small piece of data that can be stored and/or read by a web Platform (or a mobile application) during its consultation, or during the installation or use of software, regardless of the type of device used (computer, smartphone, digital tablet) when connected to the Internet.

There are different types of cookies and their use may require, pursuant to the combined provisions of Article 82 of the French Data Protection Act and Article 4 of the GDPR, to obtain prior consent of the user, who must express his willingness (freely, clearly, specifically and unequivocally) by a clear positive act (often in practice by ticking or clicking on a box dedicated to this purpose), subject to the exceptions provided for in the aforementioned texts.

However, the tracers whose sole purpose is to enable or facilitate communication by electronic means or which are strictly necessary for the provision of an online communication service in accordance with the aforementioned texts and the deliberations n°2020-092 and 2020-093 of the CNIL dated from September 17th, 2020 are exempted from prior collection of the user’s consent.

For example, the cookies considered “strictly necessary” are in particular so-called authentication tracers used to authenticate the user when he/she connects to an online platform qualified as a “logged platform” or certain audience and/or performance measurement tracers, provided that their purpose is strictly limited to measuring the Platform’s audience on behalf of the Platform’s publisher alone or to produce anonymous statistical data.

We only use « strictly necessary » cookies on our Platform and more specifically:
– authentication cookies to allow you to identify yourself more easily and securely when logging on to our Platform, and
– “technical” cookies to understand your preferences and usage patterns on our Platform. We may collect data about your browsing behavior, such as IP address, location, browser type, operating system, the visited pages and the time and date of the visits.

The purpose of these tracers is to measure the duration and type of functions used, the performance of our Platform, to detect navigation problems, to optimize the technical performance and/or the ergonomics of our Platform. We use this information to gather aggregated and anonymous statistics with a view to improving our services and your use of our Platform.

These cookies are used exclusively on behalf of SAVETRADE and are strictly necessary for the operation and day-to-day administration of our Platform. We use on our Platform Google Analytics’ tracers. These cookies are used to collect information in an anonymous format and analyze certain aspects of navigation on our Platform to produce statistics concerning its use. These cookies are not used for marketing purposes or to enable data to be cross-checked with other processing or to enable data to be passed on to third parties and/or to enable the overall tracking of your browsing behaviors on other applications and/or websites published by third parties.
We do not use any other type of tracers or cookies such as third-party application cookies, advertising partner cookies or optional cookies which require your prior consent.
The duration of the tracers we use is limited in time, namely to a period allowing a relevant comparison of audiences over time, which cannot exceed thirteen (13) months, it being specified that the information collected by these tracers is kept for a maximum period of twenty-four (24) months.
